Lawsuits, Fighter Pay, and Drug Tests: Tibau Fails Post Fight Drug Test In Addition to OoC Test

Q: The Cung Le situation of course took place in china at Hong Kong labs, and it was one of the things that was cited for kind of a change in posture from you guys as far as administering these tests on your own. Everything that you’ve listed today as far as random tests adds more responsibility to you guys in very global market. How can we be confident that these changes aren’t going to result in similar mishaps like the Cung Le situation if you guys try to do this in a self-regulated jurisdiction?

A-(Epstein) “That’s actually not the case when we’ve adjecated here today is that a third party testing organization handle all of these tests. So in the Cung Le situation we contracted with a lab in china. That’s not the model that we’re talking about going forward, were talking about partnering with a leading, worldwide anti-doping agency that will handle all of the logistics for taking those tests, getting them to the lab and of course getting the results done. So what happened in China is absolutely not what we’re talking about here today."

Q: Will you folks insist that whoever you contract with test both blood and urine?

A-(Fertitta) “Yes. Once again, it’s going to be a worldwide leader in anti-doping and testing, and they’re really the ones setting the standard for the science for the testing protocol. We’re really looking to them to tell us what needs to be done to ensure a clean sport. And from the conversations we’ve had with various entities, it would include both urine and blood so that you can detect all forms of PEDs.”

This was when Encarncao asked like 4 or 5 questions in a row. Last time I checked, said places were still open for business.

http://www.ufc.com/news/Report-Silva-to-Admit-to-Therapeutic-PED-Usage?id=

The Nevada State Athletic Commission disciplinary hearing for former UFC middleweight champion Anderson Silva does not have a set date in March, but according to a story published by Brazilian website UOL on Saturday, the MMA icon and his team are preparing his defense, with Silva reportedly planning to admit to using several banned substances.

The report makes clear that Silva will insist that his use of performance enhancing drugs wasn’t to gain an advantage on his opponent, but rather as an aid in his recovery from the broken leg suffered in his December 2013 loss to Chris Weidman. Lawyers will also argue that the amount of the substances found in his system were minimal, thus giving him no advantage over his January 31 opponent, Nick Diaz.

Silva is currently on a temporary suspension from the NSAC after testing positive for the steroids Drostanolone and Androstane on January 9, and Drostanolone on January 31 following his UFC 183 bout against Diaz. Silva tested positive Oxazepam (an anti-anxiety medication) and Temazepam, a drug used in treatment for sleep deprivation.

As for his use of the other substances, for which he also failed NSAC testing, Silva will reportedly claim that the physician-prescribed drugs, which combined produce a calming effect similar to Valium, were intended to aid in his recovery from back spasms and muscle pain that began for him when he was hospitalized last November.

Here is what UFC sent me:

Las Vegas – In a further commitment to the health and safety of its athletes, UFC® announced today the hiring of Jeff Novitzky as Vice President of Athlete Health and Performance. Novitzky will spearhead the development of the organization’s clean initiative education program designed to ensure that every athlete competes with natural ability on an even playing field.

A federal agent for the United States Food and Drug Administration (FDA) since 2008, Novitzky led investigations into companies suspected of illegal distribution of dietary supplements and designer steroids. Prior to joining the USFDA, Novitzky was a special agent for the Internal Revenue Service in their Criminal Investigation Department, where he oversaw and investigated some of the highest-profile performance enhancing drug (PED) cases in professional sports. A former collegiate athlete who played basketball for San Jose State University from 1989-91, Novitzky graduated with a degree in accounting.

UFC is committed year-round to the health, safety, and education of its athletes. Led by Novitzky, UFC will continue to invest in state of the art sports science studies, further develop its out-of-competition PED testing policy and enrich its education and prevention programs.

“There is no bigger advocate of clean professional sports than Jeff Novitzky,” UFC Senior Executive Vice President and Chief Operating Officer Lawrence Epstein said. “When we announced our commitment for an enhanced drug testing program in February, we wanted to ensure that the best people would be helping move this program forward and Jeff will lead the UFC in developing the most comprehensive anti-doping policy in professional sports.”

Novitzky added: “I am thrilled to be joining a world-class organization like UFC, that is committed to taking the necessary steps to ensure all of its athletes are competing in a clean sport. I am confident that UFC will be able to create a new gold standard testing program and implement it so a sustainable and level playing field is provided for all athletes.”

As part of its broader athlete health program, which includes the Athlete Accident Insurance Plan implemented in 2011, UFC announced in February the development of an expanded drug-testing program that will increase out-of-competition testing and pledged significant financial commitments for targeted testing protocols. Novitzky will play a leading role in the creation and implementation of the program, scheduled to be unveiled in July 2015.

Novitzky, who will join the UFC later this month in the organization’s Las Vegas headquarters, will be made available to the media in the coming weeks.

http://www.ufc.com/news/UFC-Lawsuit-Statement-041015

“As expected, the plaintiffs have filed their opposition to our motion to dismiss. Nothing in their opposition changes our view that their complaints are filled with conclusory allegations that are not adequate to support their antitrust claim. As we laid out in our motion to dismiss, UFC has competed in a lawful manner that has benefited fighters and built UFC into a premier organization in the sport of Mixed Martial Arts.

Indeed, UFC properly competes with other MMA promoters, fairly compensates its athletes and has created a product that is enjoyed by millions of fans around the world. Our legal position is solid and we intend to prevail in this lawsuit."

http://www.ufc.com/news/UFC-Makes-Key-Change-in-Reebok-Deal?utm_campaign=UFC&utm_medium=social&utm_source=twitter&utm_content=1429557176

Interesting angle if you think about the beef between Glenn Robinson (mentioned in the above article) and Dan Lambert (owner of American Top Team). There was some foreshadowing to this as I saw someone this week link back to an old article as to why they were going to root for the Blackzilians on the new season of TUF.

Add in the fact that Lambert also voiced his approval on the Reebok deal, and you get a sense that both guys stand on the opposite end of the business spectrum.

The exact breakdown of figures from single sponsor logos on UFC uniforms is still being worked out. No current deal means no specifics now.

UFC joining the list of the other major sports with stupid unveiling of new uniforms. I look forward to Vince trolling UFC becuase of his ego and around that point unveiling WWE Tapout uniforms for no real reason other than his ego.

I am not saying it won't happen, but I think Vince is little mindful of that now. They wouldn't have the Tapout deal if UFC didn't essentially freeze them out. It's not like the WWE was gonna get a Reebok deal so it actually worked out well for the UFC and WWE.

Does this mean road to settlement out of court?

Erik Magraken (@erikmagraken) has way more on it. The tl:dr version is it might lead to that. However, they are still battling over the venue and the motion to dismiss still has to be heard. So the mediation would be after that to see if there is any common ground.
